Article 18 of the Condominium Law: Maintenance and Repair

Maintenance and Repair of Common Areas: Maintenance and repair of the main structure (building) and common areas (such as stairs, roof, elevator, garden) are carried out with the participation of the condominium owners according to their share ratios.

Compulsory Maintenance and Repair: If urgent and mandatory maintenance and repair are required for the safety or use of the building, the manager is obliged to have these procedures carried out without delay. In this case, the prior approval of the condominium owners is not required, but the costs are shared later.

Sharing of Expenses: Maintenance and repair costs are shared among the condominium owners according to their share ratios.

Article 19 of the Condominium Law: Renovation and Reconstruction

Renovation Decision: A 2/3 majority of the condominium owners in the general assembly is required for the renovation of the building (such as facade renovation, roof repair, elevator replacement). This majority must be achieved both in terms of number and share ratios.

Reconstruction: If the building is to be demolished and rebuilt, a 4/5 majority of the apartment owners is required for this decision. This majority must be achieved both in terms of number and share ratio.

Right to Object: Apartment owners who do not agree with the renovation or reconstruction decision can take their objections to court.

Important Notes:

Emergencies: If urgent intervention is required for the safety or use of the building, the manager can take action without prior decision. Expenses are shared later.

Management Plan: There may be special provisions regarding maintenance, repair and renovation in the apartment management plan. Therefore, it is important to examine the management plan.

Collection of Expenses: The manager can take legal action (such as enforcement proceedings) against apartment owners who do not pay maintenance and repair expenses.
