COMPLIANCE POLICY

 

 

 

As ADA MANAGEMENT, we process the personal data of our website visitors, independent section owners and / or tenants, customers and employees in accordance with Article 20 of the Constitution, the Law No. 6698 on the Protection of Personal Data and other legal legislation and the decisions of the Personal Data Protection Authority. We would like to inform you about the ways your personal data are collected, the purposes of processing, legal reasons and your rights.

 

 

 

1. WHAT IS PERSONAL DATA AND WHO PROCESSES IT?

 

Pursuant to Article 3 of the Law No. 6698 on the Protection of Personal Data ("Law", "KVK Law"), personal data refers to any information relating to an identified or identifiable natural person. In accordance with the Law No. 6698 on the Protection of Personal Data, ADA MANAGEMENT will record, store, update, process, process, disclose and transfer your personal data to third parties in accordance with the Law in the capacity of "data controller".

 

 

 

2.BY WHICH METHOD AND ON WHAT LEGAL GROUNDS DO WE COLLECT YOUR PERSONAL DATA?

Your collected personal data may be processed by ADA MANAGEMENT for the following purposes within the personal data processing conditions specified in Articles 5 and 6 of the KVK Law;

 

 

 

- To ensure that the activities carried out by ADA MANAGEMENT are carried out in accordance with the relevant legislation, general assembly resolutions and ADA MANAGEMENT's policies,

- Checking the accuracy of your identity information and documents you have declared to ADA MANAGEMENT and maintaining your identity sample and other information that must be kept in accordance with the relevant legislation, as well as your Subscription Agreement,

- Preventing and detecting other post-subscription transactions and termination, billing, interconnection, irregularities, abuse and fraud,

- To be able to provide you with better services and to carry out analysis and studies for product and business development within the scope of technological advances/improvements,

- To provide better service to our visitors, independent unit owners and/or tenants, customers and employees on our website and to improve our services, to offer products/services, all kinds of information, advertising-promotion, promotion, sales and marketing activities,

- Providing customer services, realizing your requests, finalizing and informing your complaints, researching and measuring customer satisfaction, subscriber/consumer trends and loyalty, award, raffle, contest, contest, gift, thank you, celebration, reminder, brand collaborations, activities and information to inform you about the innovations of our management,

- Sharing the necessary information with official authorities for the fulfillment of legal obligations in the relevant legislation and for audit activities,

- Development work can be carried out by us in line with the interests and preferences of visitors, independent unit owners and/or tenants, customers and employees,

- Ensuring the legal and commercial security of ADA MANAGEMENT and persons who have established a business relationship with ADA MANAGEMENT or are in a business relationship,

- Carrying out the necessary work by our business units to benefit you depending on the product, service or commercial activity offered by ADA MANAGEMENT,

- Determining and implementing ADA MANAGEMENT's commercial and business strategies,

- It may be processed for measuring service quality, financial reporting and analysis, complaints, legal follow-up and similar purposes.

 

 

4. TO WHOM AND FOR WHAT PURPOSE CAN WE TRANSFER YOUR PERSONAL DATA?

 

Your collected personal data will be processed in accordance with Articles 8 and 9 of the LPPD. in accordance with the conditions for the transfer of personal data set out in Art;

5. LEGAL GROUNDS AND CONSENT FOR THE PROCESSING OF PERSONAL DATA,

 

If you do not have prior consent and permission, in cases where we will request your permission as required by legal obligation, you will be able to give permission in the digital environment with the same legal nature and value, together with the written signed permission, if any, in other procedures in which you establish a relationship with ADA MANAGEMENT, by checking and approving the permission boxes on the website in the permission area related to your personal data on our website or on the membership page. In this context, your personal data that you share with ADA MANAGEMENT by revealing your will to benefit from and be aware of the above written purposes, especially the product and service advantages to be provided by ADA MANAGEMENT for you, in order to provide and offer you various advantages and to make all kinds of physical and electronic communication for special advertising, sales, marketing, surveys and similar purposes and to send other communication messages; Your consent is also requested for the collection, storage, processing, use and transfer. If you have found it appropriate after evaluating this electronic communication permission and clarification text on the processing of personal data presented to your information in digital environment (sms, e-mail, mobile push notification and other), your permission / approval process will be completed if you check the approval boxes on the membership page separately and press the "send" button. 6. YOUR RIGHTS AS A PERSONAL DATA OWNER PURSUANT TO THE LAW ON THE PROTECTION OF PERSONAL DATA NUMBERED 6698 AND THE EXERCISE OF THESE RIGHTS

 

This notification aims to inform the personal data owner of the rights of the personal data owner in accordance with Article 10 of the KVK Law and to guide the personal data owner on how to exercise these rights regulated in Article 11.

 

 

 

ADA MANAGEMENT carries out the necessary channels, internal functioning, administrative and technical arrangements in accordance with Article 13 of the KVK Law in order to evaluate the rights of personal data owners and to provide the necessary information to personal data owners.

 

 

 

A. As a personal data subject, you have the following rights

 

a. Learn whether personal data is being processed,

 

b. Request information if their personal data has been processed,

 

c. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

 

d. To know the third parties to whom personal data is transferred domestically or abroad,

 

e. To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

 

f. Although it has been processed in accordance with the provisions of the KVK Law and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

 

g. In the event that a result arises against the person himself/herself by analyzing the processed data exclusively through automated systems, to object to this result,

 

h. In case of damage due to unlawful processing of personal data, to demand compensation for the damage.

 

 

 

B. Cases where you cannot assert your rights as a Personal Data Owner are as follows;

 

Pursuant to Article 28 of the KVK Law, personal data owners cannot assert their rights listed above in these matters, as the following cases are excluded from the scope of the KVK Law:

 

a. Processing of personal data for purposes such as research, planning and statistics by anonymizing them with official statistics,

 

b. Processing of personal data for artistic, historical, literary or scientific purposes or within the scope of freedom of expression, provided that it does not violate national defense, national security, public security, public order, economic security, privacy of private life or personal rights or constitute a crime,

 

c. Processing of personal data within the scope of preventive, protective and intelligence activities carried out by public institutions and organizations authorized by law to ensure national defense, national security, public security, public order or economic security,

 

d. Processing of personal data by judicial or enforcement authorities in relation to investigations, prosecutions, trials or executions.

 

 

 

Pursuant to Article 28/2 of the KVK Law; In the cases listed below, personal data owners cannot assert their other rights listed above, except for the right to demand compensation for the damage:

 

a. Processing of personal data is necessary for the prevention of crime or criminal investigation,

 

b. Processing of personal data made public by the personal data subject himself/herself,

 

c. Personal data processing is necessary for the execution of supervisory or regulatory duties and for disciplinary investigation or prosecution by authorized and authorized public institutions and organizations and professional organizations in the nature of public institutions based on the authority granted by law,

 

d. the processing of personal data is necessary for the protection of the economic and financial interests of the State in relation to budgetary, tax and fiscal matters.

 

 

 

C. Exercising Your Abovementioned Rights as a Personal Data Owner (How Will You Apply to the Data Controller?)

 

All your other rights stipulated by both the KVK Law and the Personal Data Protection Board, especially those written above;

 

a. After filling in the form available at www.adayonetim.com.tr, you can use it by delivering a wet signed copy of the form in person or in writing by registered mail with return receipt requested or through a notary public to "9213 Sk. No:11-A Reis Mahallesi Yeşilyurt Karabağlar-İzmir" or by applying in person.

 

 

 

In order for the above-mentioned application to be accepted as a valid application, in accordance with the Communiqué on Application Procedures to the Data Controller, in the application, the relevant person must state that;

 

a. Name, surname and signature if the application is in writing,

 

b. Turkish Republic identification number for citizens of the Republic of Turkey, nationality, passport number or identification number, if any, for foreigners,

 

c. Residential or workplace address for notification,

 

d. Electronic mail address, telephone and fax number for notification, if any,

 

e. It is mandatory to specify the subject of the request. Otherwise, the application will not be evaluated as a valid application. In the case of applications to be made without filling out the application form, the application will be evaluated even if the issues listed here are submitted to ADA MANAGEMENT in full.

In order for third parties to make an application request on behalf of personal data owners, the application must be made by the data owner with the submission of a special power of attorney issued through a notary public on behalf of the applicant and containing the necessary authorization regarding personal data.

 

 

 

ADA MANAGEMENT will finalize the requests duly submitted to it free of charge within thirty days at the latest. If the response is more than ten pages, a transaction fee of 1 Turkish Lira may be charged for each page over ten pages. If the response to the application is given in a recording medium such as CD, flash memory, the cost of the data recording medium may be requested separately. 

ADA MANAGEMENT may request additional information if it deems necessary to determine whether the applicant is the owner of personal data and to evaluate the requests, and may ask the personal data owner questions about the application in order to clarify the issues specified in the application.
